Terms of Service

1 Acceptance of Terms

These Terms of Service ("Terms") form a legally binding agreement between you ("you", "User") and the independent developer of Telegram AutoPoster Pro ("we", "us", "our", "the Developer"). They apply to:

• the desktop application Telegram AutoPoster Pro for Windows and macOS;
• the license activation and verification API hosted on tgautoposter.com;
• the website tgautoposter.com and all sub-pages.

By downloading, installing, activating, or otherwise using any part of the software, you confirm that you have read, understood, and accepted these Terms, together with our Privacy Policy.

2 Definitions

3 Eligibility

You may use the Software only if:

• you are at least 16 years old (or the age of digital consent in your jurisdiction, whichever is higher);
• you have the legal capacity to enter into a binding agreement;
• you are not located in a jurisdiction where the Software would be illegal to use (e.g. sanctions-restricted territories);
• you comply with Telegram's own Terms of Service and applicable local laws.

You are solely responsible for ensuring your use of the Software does not violate any applicable laws or third-party terms.

4 License grant

Subject to these Terms and to the payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the Software for your personal or internal business purposes.

Plan-specific limits

Account limits and plan features are enforced both by the Software and by the license server. Attempting to bypass them is a material breach of these Terms.

5 Trial license

• One trial license per email address — no exceptions, no re-registration with throwaway emails.
• Trial covers Standard-tier features only: DM campaigns, chains, rotation, analytics, session health, CSV/Excel/JSON import. Enterprise-only features (multi-account, auto-reply, stories, bulk operations, health monitor, full backup) are not included.
• The trial is provided as-is without any warranty.
• We may revoke trial keys if we detect abuse (automated mass-registration, resale, etc.).

6 Restrictions

You agree not to:

• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Software, except where permitted by applicable law.
• Modify, adapt, translate, or create derivative works based on the Software.
• Share, resell, rent, lease, or sublicense the Software or your license key to any third party.
• Circumvent license checks, plan limits, or the license server.
• Bypass or disable security features, auto-stop protections, or rate-limit enforcement.
• Use the Software to send spam, unsolicited bulk messages, phishing, scams, or any other content prohibited by Telegram's Terms of Service.
• Use the Software for illegal purposes, including but not limited to harassment, fraud, distributing malware, or violating any person's privacy.
• Use the Software to target minors or any vulnerable group.
• Attempt to gain unauthorized access to our servers or license infrastructure.

7 Your responsibilities

You acknowledge and agree that:

• You own your Telegram accounts. We never ask for your Telegram password, do not store your sessions on our servers, and cannot log in to your accounts.
• You are responsible for account safety. Using automation can result in Telegram restrictions or bans. You accept this risk and use the Software at your own discretion.
• You will comply with Telegram's Terms of Service (telegram.org/tos). Violating them is a violation of these Terms.
• You will comply with local laws, including anti-spam and data-protection laws applicable in your jurisdiction.
• You will keep your credentials safe. Your API ID, API Hash, phone number, and session files must not be shared with third parties.
• You are responsible for your data. We do not back up your local database, sessions, or media. Use the built-in backup feature regularly.

8 Payment & refunds

Accepted payment methods

We currently accept cryptocurrency payments: Bitcoin (BTC), Ethereum (ETH), USDT (TRC-20 and ERC-20), and TON. Card payments are in development.

Prices

All prices are in US dollars as listed on our pricing page. Crypto amounts are calculated at the exchange rate at the time of purchase.

Crypto payments are irreversible

Refund policy

Because of the above, we offer refunds only in the following limited cases:

• Duplicate payment — if you accidentally sent the same amount twice, we will refund the duplicate.
• Wrong amount — if you sent significantly more than the required amount, we will return the excess (minus network fees) on request.
• License never delivered — if we fail to deliver your key and cannot fix it within 48 hours.

Refunds are not issued for: change of mind, "I didn't like the interface", "Telegram banned my account", "I forgot to use it", or any other reason unrelated to a defect in the Software.

Chargebacks

Because crypto payments do not support chargebacks, this section is informational only. For any future card payments, we reserve the right to dispute chargebacks through our payment processor with full evidence of delivery and acceptance of these Terms.

9 Expiration & renewal

• All paid subscriptions are valid for 30 days from the date of purchase.
• Renewals are not automatic. You must renew manually to continue using the Software.
• When your license expires, the Software will stop performing new sends, campaigns, and automation. You can still open the app, view your data, and export it.
• There is a grace period of up to 30 days when our license server is unreachable — during that time you can keep working offline. See the License section in the guide for details.

10 AutoPoster Cloud (beta)

The desktop application is feature-complete. Future development is focused on AutoPoster Cloud — a managed web service currently in development.

• Cloud will have its own separate subscription and Terms.
• Supporter plan subscribers will receive early access at no additional cost.
• Beta software is provided as-is, may contain bugs, may experience downtime, and its features may change without notice.
• Data migration from the desktop app to Cloud will be made available but is not guaranteed in the beta phase.

11 Intellectual property

The Software, including its source code, design, interface, graphics, documentation, and trademark "Telegram AutoPoster Pro", is the exclusive property of the Developer and is protected by copyright and other intellectual property laws.

We do not claim ownership of:

• your Telegram accounts, messages, contacts, or media;
• your recipients lists, ads, campaigns, or analytics;
• your backup archives.

These remain yours, and yours alone. We have no access to them because they never leave your computer.

12 Third-party services

The Software connects to the official Telegram API on your behalf, using credentials you provide. Your use of Telegram is governed solely by Telegram's own terms:

• Telegram Privacy Policy

We are not affiliated with Telegram. Telegram may change its API, rate limits, or policies at any time. We do not guarantee that the Software will remain compatible with future versions of Telegram, although we will make reasonable efforts to keep it working.

13 Disclaimer of warranties

The Software is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, express or implied, including but not limited to:

• implied warranties of merchantability, fitness for a particular purpose, or non-infringement;
• warranties that the Software will be uninterrupted, error-free, or free of harmful components;
• warranties regarding the results obtained from using the Software;
• warranties that errors will be corrected.

You use the Software entirely at your own risk. We do not warrant that Telegram will not restrict or ban your accounts, nor that your campaigns will succeed.

14 Limitation of liability

To the maximum extent permitted by applicable law, the Developer shall not be liable for any of the following, whether arising in contract, tort, or otherwise:

• indirect, incidental, special, consequential, exemplary, or punitive damages;
• loss of profits, revenue, data, business opportunity, or goodwill;
• Telegram account bans, restrictions, or loss of followers;
• damage to your computer, network, or other software;
• data loss due to your own actions (deleting data/, losing backups, etc.);
• interruption of service due to Telegram outages, ISP issues, or force majeure.

Where liability cannot be excluded, our total cumulative liability arising out of or in connection with these Terms shall not exceed the amount you actually paid us in the 6 months preceding the claim.

15 Indemnification

You agree to indemnify and hold harmless the Developer from any claim, demand, loss, liability, or expense (including reasonable legal fees) arising out of:

• your use of the Software in violation of these Terms;
• your violation of any law or third-party right (including Telegram's Terms);
• any content you send through the Software;
• any claim by a third party that your use of the Software harmed them.

16 Termination

We may suspend or terminate your license immediately, without refund, if you:

• materially breach these Terms;
• use the Software for spam, phishing, fraud, or other illegal activity;
• attempt to reverse-engineer, crack, or bypass the license server;
• resell or redistribute the Software or your license key.

You may terminate this agreement at any time by uninstalling the Software and deleting the data/ folder. Termination does not entitle you to a refund.

17 Governing law

These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the Software shall be subject to the exclusive jurisdiction of the courts of the United Kingdom, unless mandatory consumer-protection laws in your country of residence provide otherwise.

Nothing in this section limits your rights as a consumer under the laws of your country of residence.

18 Changes to terms

We may update these Terms from time to time. When we do:

• we will update the "Last updated" date at the top of this page;
• for material changes, we will notify users via email (if we hold your address) or through the app's update channel;
• your continued use of the Software after changes take effect constitutes acceptance of the new Terms.

If you do not agree with the updated Terms, you should stop using the Software and uninstall it.
